People aren’t ready for the magnitude of things to come
[NEWS] A New York dealership is filing a $15M lawsuit against General Motors:
Sun GMC, Inc., in Wantagh, N.Y., alleges that General Motors deliberately starved it of inventory to force it out of business.
GM gave the dealership a sales goal of 1,000 units last year but invoiced only 501, according to the lawsuit.
The filing also said that in the past six months, Sun has received fewer than 20 vehicles per month.
"Sun cannot sell what it is not supplied,” the complaint stated.
But the lawsuit could shake things well beyond Long Island.
If discovery proceeds, GM would likely have to reveal its full allocation formula, something dealers across the country have never seen voluntarily disclosed, according to Sun’s attorney.
What this means: Every dealer who suspects unfair inventory allocation could have a stake in this case.
Because if a judge orders GM to expose its allocation system, that precedent could benefit the entire dealer body.
