Section 35 was agreed to by Alberta in the Constitution Act, 1982. Protecting Aboriginal & Treaty Rights, these are the rules established and Wab is just telling it like it is.

On the topic of Alberta separatism, Alberta Premier Danielle Smith says her province will turn to the court for clarity on what the duty to consult means.
After her remarks, Manitoba Premier Wab Kinew gave her his definition.
PM Carney: "Is it helpful to ask these fundamental questions? No, it's not helpful. Of course it's not. Is it the democratic will of Albertans? Did they vote for this in the last provincial election? No, they didn't. It wasn't on the ballot paper, it wasn't in the mandates or platforms of the governing party and the official opposition."

The Court concluded this because it considered the Chief Electoral Officer an extension of the Crown and because it considered the referendum results binding upon the government to implement which -if a yes vote-would impact Treaty rights.
The duty to consult Indigenous Peoples is not a box-checking exercise.
It is a constitutional obligation rooted in the honour of the Crown, in the treaties that underpin this country, and in the fundamental recognition that First Nations are sovereign rights holders.
Any leader willing to disregard the duty to consult in pursuit of separatist politics is not defending Alberta, they are undermining the rule of law, dishonouring treaty relationships, weakening reconciliation, and attacking the very foundations upon which Canada was built.
