लोकतंत्र में न्यायपालिका का सम्मान जितना आवश्यक है, उतना ही आवश्यक है निष्पक्ष पत्रकारिता और सार्वजनिक प्रश्नों का अधिकार। यदि दस्तावेज़ों, आरटीआई और सार्वजनिक रिकॉर्ड के आधार पर उठाए गए सवालों को भी अवमानना माना जाने लगे, तो पारदर्शिता और जवाबदेही दोनों प्रभावित होंगी।

*STATEMENT*

As per reports, the Hon’ble Delhi High Court today has issued notice to me in a plea seeking initiation of criminal contempt proceedings over one of my reports concerning the appearance of conflict of interest and reasonable apprehension of bias in Justice Swarana Kanta Sharma hearing the CBI appeal in the Delhi Excise Policy case. The petitioner alleges that my report contains “serious, unfounded and scandalous allegations” against Justice Sharma.

I stand firmly by my reporting.

The report was based entirely on documentary material: RTI data furnished by the Ministry of Law & Justice, the judge’s own judicial orders in Criminal Revision Petitions, publicly available records, and statements made by a sitting Hon’ble Judge of the Supreme Court himself.

Not a single fact reported by me has been rebutted either by the judge concerned or by the CBI in any of the proceedings, including the suo-motu contempt proceedings. In that backdrop, an unattached third party has now come into the picture.

That said, since the matter now directly concerns me and is sub-judice, it will not be appropriate to comment further on the merits at this stage. I shall place my response before the Court after consulting distinguished members of the Bar, eminent legal luminaries, and respected members of the fraternity.

The constitutional guarantee of free speech includes the right, not just of journalists, but of every citizen, to fairly scrutinise and critique judicial functioning and administrative decisions that have a bearing on public confidence in the institution. The faith in the institution can never be strengthened through opacity or the chilling of public scrutiny.

Journalism that seeks to uncover these uncomfortable facts in the largest of public interests is part of the constitutional duty of the fourth pillar. Questions cannot be contempt.✊🏻

@MOIDFDE जहां तक “घर की औरतों” वाला ज्ञान है, लोकतंत्र घर की चौखट पर नहीं, सार्वजनिक जवाबदेही पर चलता है।
प्रधानमंत्री कोई पारिवारिक मुखिया नहीं, जनता द्वारा चुने गए संवैधानिक पद पर बैठे व्यक्ति हैं। उनसे सवाल पूछना अधिकार भी है और लोकतांत्रिक कर्तव्य भी।

In a democracy, questions are not an inconvenience they are the foundation of accountability. Scripted interviews can never replace open press conferences and direct public scrutiny.

Not a single press conference by the Prime Minister held in the country since 2014. Only select interviews with filtered pliant questions. This is the world’s largest democracy and the press has a right to ask questions directly to its elected Prime Minister. One way Mann Ki Baat is not an alternative to a PC. Diplomats, bureaucrats and ministers answering questions are not the same as heads of states and governments answering media questions in a democracy. That is called accountability and responsibility. There are countries where press freedom is taken seriously. And India has stopped the tradition of foreign heads of govts and states taking questions after their press statements with the PM following formal talks in Delhi .Similarly except for the US where the PM is forced to take two Qs (fixed from the Indian side) and initial UK trip in 2015, foreign heads of states and govts have stopped taking Qs from their press after joint remarks of top leaders because of the insistence from the visiting Indian govt side. This needs to stop. Surely a Prime Minister who enjoys such a strong mandate cannot continue to shy away from legitimate questions that others answering on his behalf will not carry the same weight.

आर्काइव | सूर्यकांत पर गंभीर अनियमित्ता के आरोप हैं. 2012 में एक रियल एस्टेट एजेंट ने सूर्यकांत पर कम कीमत दिखा कर करोड़ों रुपए की संपत्ति का अवैध कारोबार करने का आरोप लगाया था. 2017 में पंजाब में एक कैदी ने याचिका दायर कर सूर्यकांत पर 8 मामलों में रिश्वत लेकर जमानत देने का आरोप लगाया. इस याचिका पर छह सालों तक कॉलेजियम ने सुनवाई नहीं की और वे पंजाब और हरियाणा हाईकोर्ट के जज बने रहे. अक्टूबर 2018 में उन्हें हिमाचल प्रदेश हाईकोर्ट का मुख्य न्यायाधीश बना दिया गया और अब उनके खिलाफ शिकायतों का निवारण किए बिना कॉलेजियम ने उन्हें मुख्य न्यायाधीश नियुक्त कर दिया. एक पूर्व जज के अनुसार, सुप्रीम कोर्ट में सूर्यकांत को पदोन्नत करने के लिए भी कॉलेजियम यही करने वाला है.
