TRO WILL BE ENTERED by a judge to allow Jim Harbaugh to coach the Michigan football team tomorrow, that's my prediction.
Not sure why the Big Ten waited until a Friday afternoon on a court holiday to suspend Harbaugh. It's a strategic error. It looks bad and makes it all the easier for a judge to step in to issue an order allowing Harbaugh to coach tomorrow.
Michigan's and Harbaugh's lawyers were surely prepared for this and ready to get their lawsuit and motion for TRO before a judge this evening to act on it promptly.
I did a lot of this type of work when I litigated automotive supply chain disputes. The key showing to get the TRO is a likelihood of success on the merits and irreparable harm. It's challenging to show irreparable harm in commercial settings because usually an award of money damages at a later time will make the party whole. But that's not the case here.
In this setting, Harbaugh missing important games and the team and University not having it's coach cannot be repaired with money after the fact. Harbaugh missing the game tomorrow would cause irreparable harm to Harbaugh and the University in many ways. An award of money damages at a later date doesn't repair that harm. I agree with the published analysis of retired Washtenaw County Circuit Court Chief Judge Donald Shelton on this point.
Given the facts and circumstances, it's highly likely that a judge will enter a TRO and Coach Harbaugh will be on the sidelines at Penn State tomorrow.
