GOOD PEOPLE...
When lawyers appear before judge(s) in Kenyan courts, they just don't open the files and argue their cases straightaway. They are not robots. Instead, they immediately take the judge(s) they are appearing before through a rich data processing machine full of the judge(s) past cases, peer review data, anecdotal evidence, known and known allegations of corruption, whether he is pro-government or independent etc and then shares with the client the outcome of the data review. After the review, the lawyer and client exercise one of three options. First, the client may give a vote of confidence because the judge(s) pass the integrity test, and the case can proceed to hearing. Second, the client instructs his advocate to ask the judge(s) to recuse himself/themselves from hearing the case. In such an application, the client and lawyer may not have the physical evidence of impropriety or bias but all the parties including the judge(s) and the opposing counsel are on the same page...an assumption that what the lawyer is alleging in true even though no physical evidence to support the allegations can be produced at that stage. Such evidence is usually widespread and known among lawyers. The third option is that the lawyer is instructed by his client to argue the case, knowing too well the judge is bribed (and has a history of corrupt past) by the opposing party, and judgment will be against him client. During the option, the lawyer will prosecute the case with an appellate strategy to the Court of Appeal in mind. So, GOOD PEOPLE OF KENYA, when you see lawyers desperately struggling to get judge(s) disqualified from hearing a case, it is not an easy/light decision. They have agonised over it and is usually a desperate last ditch attempt to get justice for the client well aware or reasonably suspicious that the courtroom had been turned into a slaughter house. The demeanor, body language and conduct of lawyers (over confidence, gloating, use of harsh and dismissive words against lawyers on the said are telling in that regard) on the opposite side is a pointer on whose side the judge(s) are.
We have the other Kajwang and then we have Moses Kajwang. And btw why is it so hard to recall a legislator but easy to send home governors, DP and President?
