After the 2012 scholarly 400 page judgement of Alberta’s Rooke J in Meads v Meads, & Canadian academic commentary on it, many refer to this as ‘pseudo-law’.

@jeremy_gans Is it not also in error to parenthetically say “presumably the Court had no power to order a retrial”? It could have, yes (albeit to have done so would have been inconsistent with its own reasoning - that on the evidence a safe conviction was not possible)?
