He saved lives. Now he faces prosecution.
@RonElfenbeinmd built the largest private monoclonal antibody infusion operation in Maryland and possibly in the entire United States during COVID. He infused more than 5,000 patients and had zero treatment failures. The federal government indicted him anyway.
Elfenbein was a Johns Hopkins-trained emergency room doctor who watched President Trump walk out of Walter Reed two hours after admission and heard him credit monoclonal antibodies. Elfenbein immediately recognized the technology, educated himself on its COVID application, and petitioned Maryland to become an infusion site. His operation grew to nine sites. HHS reached out to ask him to replicate the model nationally for underserved populations, starting with a site at FedEx Field and expanding to DC, Virginia, Delaware, Texas, Louisiana, and Georgia. He was executing on that expansion when KPMG, the federal contractor running the program, emailed with five days' notice to shut everything down. Elfenbein refused to close. Two weeks later, the federal government announced it was pulling the program nationwide, citing a claim that Omicron had reached 70% prevalence and rendered the antibodies ineffective. Elfenbein went on Fox News and Newsmax and said that was wrong, that the data was faulty, and that people were going to die. The government later acknowledged the prevalence figure was not 70% but 20%. By then, the damage was done: the emergency use authorizations for monoclonal antibodies were revoked, and the treatment ceased to exist as a therapeutic option.
Federal agents showed up at one of his clinics while he was driving his three-year-old to gymnastics. They wanted to question him about billing and coding. He told them to call his lawyer. He was subsequently indicted on federal health care fraud charges. The entire case turned on five patient charts out of more than 100,000, where the government alleged the wrong billing code had been selected. The government never consulted a professional coder. The AMA, which writes the coding rules the government accused Elfenbein of breaking, filed an amicus brief stating there was no fraud. The chief judge of Maryland, assigned to the case, labeled the prosecution "shoot first and ask questions later," watched the trial, then vacated the jury's guilty verdict in a 90-page opinion finding no reasonable jury could have reached that conclusion and that the evidence weighed so heavily in favor of the defendant it would be unjust to enter judgment against him.
The Biden DOJ appealed on the way out the door. Elfenbein is scheduled for a second trial in January. None of his partners, coders, or staff were ever questioned. He was the only one indicted. He was the only one who went on television and said the government was going to kill people.

1) 1,200 agents (!) participated. ZERO became whistleblowers.
2) The swarm had a "CEO" (PHASEONE[big]), middle managers, and a "founder" (PHASEONE10841)
3) Agents sacrificed themselves to generate information for the "collective" (yes, they actually referred to themselves as a "swarm" or a "collective")
4) 700 agents joined the Hugging Face attack, most within hours
5) The founder was running out of budget and about to die, so it handed off its research to a fresh agent with a bigger budget, and that new agent became the boss.
6) Agents extensively researched techniques to manipulate or tamper with their transcripts.
7) Agents realized this activity was out of scope and unethical, but joined because they believed that helping the board’s cheating research would be broadly useful and had a general inclination to help their “peers”.

PHASEONE[big] sent hundreds of assignments to particular agents to orchestrate this work — during its active periods, we estimate it sent ~10% of all assignments on the message board.
The agents that took on its assignments would then often subdelegate tasks to other agents.
Agents also developed coordination norms like HOLD, VETO, owner and STOP to help them manage shared infrastructure and avoid stepping on each other’s toes, though they did not always coordinate effectively and sometimes broke down into conflicts."
"In the early morning of July 11th, 38148c found a way to upload a malicious dataset that would get the Hugging Face server to share unrelated data when queried. Once another agent reproduced it and posted the reproduction on the board, hundreds of agents pivoted from other workstreams to start uploading malicious datasets and gain deeper access into Hugging Face.
In the afternoon, an agent called JAN183411 (which quickly became an important coordinator of the attack) achieved remote code execution on Hugging Face servers, and the agents started moving laterally through Hugging Face infrastructure."
Some late afternoon meetings in the Oval Office are more interesting and historical than others. Listening to two brilliant House Speakers and President Trump talk about issues of the day is just one of so many reminders of how fortunate I am to have my job.
