Agreed. But HC judges aren’t interpreters of the Constitution ONLY the SC & no case has gone to the SC as far as we know. Nonetheless, even the new bill was written only for “the lgbtqi+ so the punitive measures doesn’t relate to heterosexuals. Pls take a look at it.
@jomokenyata Lol. You cant say the law wasn't written for heterosexuals.. judges have already analysed that law and concluded that it doesn't explicitly apply to LGBTQ. It was basically the groundwork for this new bill ready to be passed.
Understanding any constitution, means stepping into the mind of the framers (devoid of any biases) to interpret it. The law wasn’t written for heterosexuals so interpreting it vaguely is only for argument purposes. Anyway, I guess that’s why we have the Supreme Court justices.
@Mants3_Adjei @jomokenyata@IcanKudivo This is not the first time an argument is being raised on what that those clauses mean. However people arent wrong in interpreting it as the law criminalising oral and anal sex even among the opposite sex.
Please, the conversation here is only in reference to our constitution as described by our customary law. Our customs defines “unnatural carnal knowledge” as any sexual activity, with anyone/thing, other than that with the opposite sex (above 16). There’s no ambiguity in that.
@jomokenyata@KorpisahA@IcanKudivo It criminalises unnatural carnal knowledge with any person above 16 years (with or without consent) or an animal. 104(2) of Act 29 simply defines what unnatural carnal knowledge means. In simple terms you are both wrong, although you are closer to the answer.
