The Shell of Rule of Law and False Allies: The ‘Venezuelan’ Warning Signs Facing South Korea

South Korea’s democracy is ceasing to function. More precisely, only the formal shell of democracy remains while its internal organs are gradually decaying. The weaponization of the legislature, the subordination of the judiciary, and the existence of a ‘false opposition’ that tolerates systemic disruption while preserving its own share of power bear an unsettling resemblance to the pattern of decline that once drove another nation into ruin.

1. The Weaponization of Legislation and the Judiciary Reduced to a Rubber Stamp

What is unfolding in South Korea is not Rule of Law, but Rule by Law. A dominant political force, backed by a massive parliamentary majority, uses legislative power not as an instrument of public governance but as a shield against its own legal risks. Investigative bodies are weakened, and lawmaking authority is turned into personal political armor. This is not routine partisan conflict. It is the erosion of the fundamental principle of separation of powers — the early stage of legislative power becoming a tool of domination.

Meanwhile, the judiciary responds with politically charged rulings, shifting from guardian of constitutional order to gatekeeper of power. When courts apply elastic standards depending on political alignment, and when actions that destabilize institutional order are effectively excused, the final safeguard of the state begins to collapse. When judges become political actors in robes, citizens no longer stand equal before the law — they stand subordinate to power.

2. The Normalization of Impeachment and the Acceleration of Structural Breakdown

Impeachment is a constitutional emergency mechanism. When it becomes a routine political instrument, it ceases to protect order and begins to dismantle it. If ‘political disagreement’ replaces clear legal violation as grounds for removal, governance stalls and institutional stability erodes. A legislature and judiciary acting in tandem to remove elected authority under the banner of procedural legitimacy represents a subtle but powerful form of institutional distortion. It is domination presented as legality.
