Let's learn a little about the powers of a Nigerian Police Man today:
1. Can the Police arrest you without an arrest warrant?
-YES, they can. Section 32 of the Police Act 2020 gives them this power.
2. Can the Police search your house/office/premises without a search warrant?
-NO, they cannot. Section 58 of the Police Act and Section 37 of the Constitution expressly prohibits them from doing this.
3. Can the Police search your CAR without a search warrant?
-YES, they can, by virtue of Section 49 of the Police Act 2020.
4. Can the Police arrest you because you are owing someone money?
-NO, the Police is not a debt collector. McLarens v Jennings (2003) 3 NWLR (Pt. 808) 470; Madaki & Anor v GTB (2022) LPELR-57419(CA).
5. Can the Police arrest you for a crime committed by your family member or your friend?
-NO. Such Police Officer should actually be sued in a civil action by the person arrested. ACB v Okonkwo (1997) 1 NWLR( pt. 480) 195.
