As much as a further delay is frustrating I think in the long run it is for the best. If the Judge just dismissed the request or gave the appearance of not taking the request seriously it could strengthen the opponents case that it was not a fair process when they challenge a presumably positive rescheduling outcome later…because we all know that there will be lawsuits from the prohibitionists 🙄. They are trying to delay the inevitable with these frivolous things because they cannot refute the science 🥂
