Oh, and like arbitrary permitting for newspaper boxes, it is likely unconstitutional and will invite a 1st Amendment suit that the city will be on the hook for.

@JohnFPfaff Yes. There’s quite a bit involving circumstances where a defendant “became the aggressor,”thereby defeating a self-defense claim. It comes up in shootout and retaliation cases.

@OrinKerr Yep. My colleague’s own Martinez v. Illinois, 572 U.S. 833 (2014). It was once a practice here for a judge to threaten to rush to a sham trial and acquittal to make jeopardy attach.

@steve_vladeck Didn’t even put the prosecutors name in the concurrence. The silence makes it that much harder for a petitioner to show a pattern of misconduct in the next case down the line.

@ryanclinton There’s always some gentler, low-stakes motion that can be filed to poke a court to look at a Penang case. Move to cite meh new authority. Move to correct a typo on page 5 of the reply brief.

There’s a minor justification error in the citation in Footnote 1 of their motion. Therefore, no one in Michigan can exercise any rights.
