When no one else would lift a finger to help backlogged immigrants maintain their H4-EAD, Immigration Voice acted to fight the good fight. Today, the D.C. Circuit said we were right to do so and affirmed the legality of the #H4EAD program. Court ruling says: State Department has the complete authority to pick VB date which is not subject to judicial review.
The Judge ruled: DOJ (as “Defendant”) argued that “no legal consequence flows from the publication of the Visa Bulletin because USCIS makes final determinations with regard to specific applicants” and the Court agreed that “Defendants have convinced the Court that "rights or obligations" are not determined by these Visa Bulletins, and that no "legal consequences" flow from their issuance...
