Menendez Conviction Called into Question
A Superior Court Judge ruled that Los Angeles County District Attorney Nathan Hochman must explain why exculpatory evidence was kept from the jury in the second trial of Erik and Lyle Menendez regarding their claims of sexual abuse
LA Magazine - A Superior Court Judge has ruled that a habeas corpus motion filed by lawyers for Lyle and Erik Menendez, who argued evidence that the brothers were sexually brutalized by their father, is valid, which could be a step toward invalidating their convictions.
Lawyers for the Menendez brothers filed their motion arguing that evidence regarding the abuse the brothers suffered at the hands of their father, José Menendez, in the years before they killed their parents in a sensational double homicide in Beverly Hills was kept from a jury that convicted them in 1996.
Judge William Ryan ruled that two new pieces of evidence would, more likely than not, have changed the outcome of their convictions - a letter from Erik Menendez to his cousin Andy Cano, which the defense "allege corroborates Cano's testimony and the sexual abuse allegations," the brothers made at trial. The second piece of new evidence is a declaration from Roy Rossello, a member of the band Menudo who says he was raped by José Menendez.
Hochman argued that both the Cano Letter and the Rossello declaration do not constitute "new evidence," but the judge disagreed and ordered his prosecutors to show cause within thirty days.
