In a unanimous decision, the apex court dismissed an appeal filed by the All Progressives Congress (APC) and its candidate, Senator Ovie Omo-Agege, challenging the outcome of the governorship election held in the state on March 18, 2023. The court, led by Justice Inyang Okoro, stated that the appeal lacked merit as the APC and its candidate failed to prove that the election was not conducted in substantial compliance with the Electoral Act 2023.
The court also dismissed Omo-Agegeโs contention regarding the lack of serial numbers on some result sheets used by the Independent National Electoral Commission (INEC) to declare the election winner. The court emphasized that even without the complained-about INEC forms, it would not affect the margin of lead in favor of the election winner, Oborevwori.
Consequently, the court held that the appellants failed to meet the burden of proof required by the law to set aside the judgments of both the Court of Appeal and the Delta State Governorship Election Petitions Tribunal. The petition was dismissed without cost.
