Ngân hàng Nhà nước (NHNN) vừa phản hồi một số thông tin chưa chính xác liên quan Dự thảo Thông tư quy định về trình tự, thủ tục giám sát hoạt động phòng, chống rửa tiền trong lĩnh vực tiền tệ và hoạt động ngân hàng.

Theo NHNN, thời gian gần đây cơ quan này đang lấy ý kiến đối với dự thảo. Tuy nhiên, dư luận xuất hiện một số thông tin chưa đúng về bản chất pháp lý và một số quy định tại Dự thảo Thông tư.

Cơ quan quản lý cho biết việc phản hồi nhằm làm rõ mục tiêu của các quy định pháp luật và những nội dung được nêu trong dự thảo.

Về thông tin cho rằng cơ quan quản lý đang "phòng chống rửa tiền với khách VIP, lãnh đạo ngân hàng", "đưa khách VIP, lãnh đạo ngân hàng vào diện giám sát chống rửa tiền", hoặc các nhóm khách hàng đặc thù, khách VIP, khách hàng ưu tiên phải được thống kê và theo dõi riêng biệt, NHNN cho biết theo khoản 2 Điều 1 và khoản 2 Điều 2 Dự thảo Thông tư, đối tượng giám sát của Thông tư là các đối tượng báo cáo.

Các đối tượng này gồm tổ chức tín dụng, chi nhánh ngân hàng nước ngoài, tổ chức trung gian thanh toán..., là các pháp nhân, không phải cá nhân khách hàng hay cá nhân lãnh đạo ngân hàng.
Dự thảo cũng có nội dung thu thập thông tin về cơ cấu tổ chức, mô hình quản trị, điều hành, kiểm soát tại đối tượng giám sát, gồm thông tin về Hội đồng quản trị, Ban Giám đốc, tỷ lệ sở hữu, Ban kiểm soát, cổ đông lớn, quy mô vốn…

Theo NHNN, đây là những thông tin các ngân hàng đang có trách nhiệm báo cáo tại Báo cáo giám sát an toàn vi mô theo quy định tại Thông tư 08/2022/TT-NHNN, Luật Tổ chức tín dụng và pháp luật về chứng khoán.

Những thông tin này là thông tin cơ bản, tổng quan phục vụ việc giám sát và đánh giá tổ chức tín dụng từ góc độ cơ cấu lãnh đạo quản lý, quy mô và cấu trúc của đơn vị.
