Brazil has produced something unprecedented in the world: the repatriation of assets to the person convicted of corruption, not to the victims.

The impunity of corruption in the country has reached an extreme that shocks the world.

Two years ago, Justice Dias Toffoli from Brazil’s Supreme Court annulled all evidence from Odebrecht’s leniency agreement — one of the largest corruption schemes ever uncovered in history. Yet the Supreme Court has still not ruled on the appeals against this single-judge decision. Meanwhile, hundreds of Brazilian and foreign corrupt actors have already benefited from it.
At the time, Transparency International warned that this would be an atomic bomb of impunity and that Brazil would become a graveyard for evidence of transnational corruption. Experts also warned that Switzerland would have to start returning seized money for the corrupt— something many believed was impossible or just a joke.

Justice Toffoli’s decision and the Supreme Court’s inertia in this case represent one of the most blatant violations of international anti-corruption treaties, particularly the OECD Convention on Combating Bribery of Foreign Public Officials.

Important: Justice Toffoli was mentioned in the plea bargain he himself annulled.
