@arabacahin @kmerchtips_ph if the seller is not registered with SEC and DTI then the applicableaw isnthe Article 315 of the Revised Penal Code

but if the seller is registered with the said agencies, then the applicable law is the Consumer Act of the Philippines.

If a seller tells you that they've secured your item but actually have not, and you have proof of this as well as receipts of your payment, you can report them to DTI or NBI, as it violates The Consumer Act of The Philippines (R.A. No. 7394).

for example: if a shop's t&c doesn't have late fees when you ordered, and then they changed it to have late fees afterwards, you are not obligated to pay any fees because you did not agree to these new terms.

we suggest reading t&cs every time you order to be safe!

terms & conditions don't exempt shops from responsibilities. changes in t&cs after a GO are NOT APPLICABLE to PREVIOUS orders, because the new t&c are not what your buyers agreed to. t&cs are NOT and SHOULD NOT be retroactive!

always check for and read a shop's terms & conditions! many shops invest huge amounts of money to provide affordable merch. "di ko po alam na may fees" is not a valid reason for not paying.

sellers are REQUIRED to indicate prices on their posts (excluding items explicitly for bidding) - this is actually a law. we advise not to engage sellers who refuse to declare their pricing, as it encourages exploitative selling practices.
