The Republic v. Charles Bissue & 2 Others

On 15 April 2026 an Accra High Court (General Jurisdiction 10) ruled that the OSP has no prosecutorial mandate and ordered it to hand over its cases to the Attorney-General.

Following this ruling, the OSP took ongoing steps to have the ruling set aside. Since then, other High Courts have adjourned pending cases initiated by the OSP to await the judgment of the Supreme Court in another case in which the prosecutorial mandate of the OSP has been challenged.

The OSP requested the Court trying Charles Bissue (Criminal Court 4) for a temporary halt in the proceedings to await the judgment of the Supreme Court.

On 22 June 2026, the Court held that the ruling of the Judge sitting at General Jurisdiction 10 is not binding on Criminal Court 4 since they are of cognate jurisdiction. The Court ordered the matter to take its normal course from 23 June 2026.

On 23 June 2026, the OSP indicated to the Court that it will call its first witness on 6 July 2026. The Court adjourned the case to 6 July 2026.

In June 2025, Thomas Andy Owusu, who was jointly charged with Mr. Bissue, admitted wrongdoing, entered into a plea agreement with the OSP, and was subsequently convicted by the High Court in connection with the same matter.

Contrary to reports by some media outlets, the OSP has neither stated nor suggested that it intends to enter a nolle prosequi in the matter.
