Bad take alert. 🚨 There is no controversy. If Miranda (which is not a Constitutional right) is violated, the remedy is the confession is thrown out. Been that way since 1966. It only becomes controversial now that some want to attach a claim for damages under 42 U.S.C. Sec 1983.
In Vega v. Tikoh, SCOTUS should hold that Miranda warnings, although constitutionally based, aren’t a constitutional “right.” The Government will & should win. I don’t usually disagree with the Court’s liberal wing, but here the dissent will be mistaken.
