alien is, as a whole, “unavailable”. " AC21 is applied. This should cover the scenario that you are stating, and should continue the three-year extensions.

@AmyMaldonadoLaw (2/2) So how come I got those 3 year extensions? If S.386 passes, even then the priority dates will continue to move like it does now. And that to me means people will continue to get 3 years H1B extensions.

@AmyMaldonadoLaw (1/2) I have received three-year extensions twice. Both times the priority date tables didn't list India as unavailable. The tables just had a date which was prior to my priority date. Which means green card numbers where available to some Indian, just not me.

Immigration Policies can be fair, w/o discrimination on Natl origin. Our system resulting in multi-decade waits for Green Cards for some Nationalities but not others has a simple bi-partisan fix - #HR392. My great grandfather (and David’s) Issac Benioff was immigrant from Kiev.
