@DavidWoycechow2 @Rachael_IP They do. But tone matters, a lot. I spend a lot of time removing stuff from 1st drafts that are arrogant and unnecessary for the purpose of the brief. It itches, when opposing counsel raises outrageous arguments. But judges are not dumb. So I keep my snarkiness for the 1st draft.

I am an EU-based lawyer, but I disagree. The only reason to withdraw the opposition is PR. Even from a layman perspective: are you suggesting no part of the public would associate that BLM-sign with adidas?

But when you look at the difference in color and shape of the stripes, I think that Adidas is unlikely to win this case if it goes to trial.
