DUTERTE APPOINTEES IN CA REVERSE DE LIMA ACQUITTAL A DAY AFTER SHE JOINS VP IMPEACHMENT PANEL
The Court of Appeals (CA) Eighth Division, composed mostly of appointees of former president Rodrigo Duterte, has reversed the 2023 acquittal of former senator Leila de Lima in one of her drug cases—just a day after she accepted House Speaker Martin Romualdez's invitation to join the prosecution panel in the upcoming impeachment trial of Vice President Sara Duterte.
The CA ruling, made public on Thursday, May 15, granted the petition for certiorari filed by Solicitor General Menardo Guevarra, Duterte's former justice secretary. The reversal paves the way for further litigation despite De Lima's earlier acquittal by a lower court.
Associate Justice Eleuterio Bathan, a Duterte appointee, penned the decision. He was joined by fellow Duterte appointee Justice Florencio Mamauag Jr., and division chair Justice Nina Antonio-Valenzuela, who was appointed by former president Gloria Macapagal-Arroyo.
De Lima, who is set to take a congressional seat through the ML party-list, will remain free while her legal team appeals the decision to the Supreme Court.
De Lima's inclusion in the House panel prosecuting Duterte's daughter, the Vice President, has fueled speculation about political motivations behind the CA decision.

House Quad Committee Co-chairperson Dan Fernandez believes that the sudden decision of former President Rodrigo Duterte to attend the hearing—despite it already being announced as canceled—was intentional.
