The Office of the Director of Public Prosecution today tabled its submissions opposing the release of Kevin Kangethe on Bail/bond pending hearing and determination of the extradition application before Milimani Law courts Chief Magistrate Hon. Lucas Onyina.
The prosecution through Vincent Monda and Magdaline Nduati presented to the court six compelling reasons to justify the opposition to bail/bond among them the respondent being a flight risk noting that he fled the United States of America immediately after committing the offence leading to the Chelsea court in USA issuing a warrant of arrest against him as well as a red alert raised by Interpol.
The second reason the prosecution argued was that the nature and seriousness of the offence committed and the likely punishment to be meted if found guilty. Prosecution invited the court to assess the offence of first degree murder committed by the respondent and the punishment of life imprisonment without the possibility of a parole.
They further argue that the conduct of the respondent who at the time of committing the offence was a resident of the united states of America but immediately fled the jurisdiction to Kenya with a view to avoid arrest. This conduct of having left the USA without a bona fide reason according to the prosecution, portrays that of a guilty mind.
The prosecution further noted that the circumstances that the status of the respondent changed and is now a fugitive criminal pursuant to Section 2 of the extradition (Contiguous and foreign countries) act CAP 76 as he has formally been indicted in the USA.
The prosecution went on to tell the court that since Kenya ratified extradition treaty with the USA, it is obligated under the national interests and international obligations to provide any assistance whenever needed and such a case falls under the category thus the need to deny bond and facilitate his extradition to face trial in the USA.
They added that the totality of facts and circumstances are that the respondent at the time of his arrest was found to be in possession of the victim’s driving license, Bank of America debit card and Capital one Visa card noting that the doctrine of recent possession places the respondent at the scene of crime.
Prosecution concluded by telling the court that all facts presented are enough justified reasons against the release of the respondent on bail pending hearing and determination of the matter.
Kevin Kangethe is facing an extradition to the United States to face charges of first degree murder at the Chelsea District Court in the states of Massachusetts.
The ruling on the application will be delivered on 18th April, 2024.

The Milimani Chief Magistrate Court today convicted a man charged in 2016 with several offences arising from the Prevention of Terrorism Act, and Kenya Citizenship and Immigration Act No. 12 of 2011.
Mohamed Abdi Ali alias Abu Fidaa, alias Abu Shuhadaa, alias Abu Ramzi was charged with being a member of a terrorist group, namely the ISIS terror group, organizing a meeting in support of terrorist groups, recruitment of members to a terrorist group, collection of information, and possession of articles connected with the commission of terrorist acts.
While delivering the judgment, the Chief Magistrate, Hon. Martha Mutuku currently at Kerugoya Magistrate Court, ruled that the prosecution proved the case against Mohammed Abdi Ali beyond a reasonable doubt through testimonies from 26 witnesses, including the Anti-Terrorism Police Unit (ATPU), FBI from US and Uganda Police.
During sentencing submission, the prosecution led by SPPC Duncan Ondimu, OGW, sought a custodial sentence of up to 90 years due to the seriousness of the offences and the impact they would have had on the country, the defenseless nature of the victims, the intelligence of the convict, who is a medical doctor, implying that he knew what he was doing, and the fact that he would have used technology to perpetrate the crimes.
The court, however, acquitted Nuseibah Mohamed Haji, Alias Umm Fidaa, and Alias Ummu Fidaa who had been charged together with the convict.
Mohamed Abdi Ali was arrested on the 29th April, 2016 at his residence in Wote Town within Makueni County, while Nuseibah Mohamed Haji was arrested at the Entebbe International Airport in the Republic of Uganda pursuant to investigations that linked them to the intended establishment of an ISIS caliphate in Kenya and East Africa.
The sentencing is scheduled for 22/04/2024.

Former MCA for Riruta Ward Samuel Ndungu Njoroge is one of the three accused persons sentenced to 30 years imprisonment each by a High Court in Kiambu today for the offence of murder.
While delivering the sentence, Justice (Prof) Joel Ngugi stated that the accused persons brutally murdered the deceased Lucy Njambi Nyagiko who was not yet 25 years old.
The judge further stated that the act of the accused persons was an extreme act of domestic violence and femicide carried out in the most brutish and sadistic ways.
The accused persons were Samuel Ndungu Njoroge, the deceased's husband and former MCA for Riruta Ward; Joyce Njambi Mungai and Wilson Mwangi Munyua.
The deceased was abducted, raped, and assaulted with sulfuric acid after which she died a day later. The offence was committed on 24th January, 2018 in Kiambu County.
