📢 Employee cannot be penalized if the employer fails to deposit TDS with the revenue: Delhi HC

➡️ In the case of Harshdip Singh Dhillon vs Union of India, the Delhi High Court passed an order in favor of the petitioner, stating that the employee cannot be penalized when the employer fails to deposit TDS.

➡️ Harshdip Singh Dhillon was employed with Tulip Telecom Ltd., and the employer collected Tax at Source from his salaries for the assessment years 2011–12 and 2012–13. However, the employer failed to deposit the withheld tax for the assessment year 2012–13.

➡️ Despite notifying the relevant Income Tax Officials of the default and the employer's failure to provide the necessary TDS certificate, no action was taken. The revenue later raised a demand against the petitioner for overdue tax debt.

➡️ The petitioner argued that he made representations to the respondent, highlighting the employer's defaults, but the respondent issued a notice for demanding tax without considering the submissions.

➡️ The court ruled in favor of the petitioner, stating that since he accepted salary after deduction of income tax at source, it is the employer's responsibility to deposit the same with the revenue authorities. Therefore, the petitioner cannot be burdened with the liability, and the writ petition was allowed.

In simple terms: if there is demand, supply is created.

The challenge for Lakshadweep now will be: (a) not to create a bad tourist experience, so that they get repeat customers (b) sustain the spike in demand that it has received
