Given the FTC's ban on **all** non-competes, here's my take regarding executive non-competes: while the ban allows existing "senior executive" non-competes, the definition seems restrictive & (I think) puts businesses at risk. My thoughts on the ethics of non-competes in link:
I find the arguments of Commissioners Holyoak and Ferguson VERY persuasive. It has bothered me all along whether or not the FTC actually has the jurisdiction to regulate employee non-competes (the enforcement of which as historically been left to the states)
As a (former) lawyer - I so appreciate the clear reasoning of Commissioner Melissa Holyoak regarding the lack of jurisdiction for the FTC to regulate employee non-competes
