1. What the CR text actually says (your page 57 image)

Section 2142 extends the enhanced ACA premium tax credits, also called subsidies. These subsidies apply to people buying insurance through the ACA marketplace. Eligibility is based on income and lawful presence in the United States.

By law, undocumented immigrants cannot receive ACA premium tax credits. This restriction is written into the Affordable Care Act itself in 42 U.S.C. § 18071 and related sections.

2. The 200 billion figure

Republicans are pointing to the ten year cost of making ACA subsidies permanent, which the Congressional Budget Office estimates at around 200 billion over a decade. They are then falsely claiming that this money goes to illegal immigrants. In reality, it goes to citizens and lawfully present immigrants to help them afford coverage.

3. Why undocumented immigrants are excluded

The ACA explicitly bars people who are not lawfully present from receiving subsidies or enrolling in marketplace coverage. This has been upheld and reinforced in federal regulations and guidance. Only U.S. citizens, green card holders, DACA recipients, and other legally present groups can qualify.

4. What is really happening

The Democratic CR locks in lower premiums for millions of middle class Americans and ends the subsidy cliff. Republicans are trying to reframe that as subsidies to illegals, even though that is legally impossible. The money goes to working families like teachers, nurses, and small business owners who buy ACA coverage and would otherwise face steep premium hikes.

Bottom line

The claim of 200 billion in subsidies to illegal aliens is a lie. The provision is about permanent ACA subsidies for lawfully present people. The CBO projects the cost at around 200 billion over ten years, and none of that money can legally go to undocumented immigrants.
