USPTO made Ex parte Baurin precedential (6 Aug). ARP reversed the Board and put the examiner’s OTDP rejection back. Anti-harassment / separate ownership can stand alone as an OTDP rationale, even with no term extension. The panel also asked the court to take another look.

Nadella is right that AI buyers pay twice, once in tokens and once in the know-how they feed the model. His fix is essentially to keep that know-how in-house. Fair enough, but secrecy is the most fragile form of protection precisely in the world he describes, where every prompt, correction, and eval is a small leak. A trade secret protects only what you can still hide. For genuinely novel work, the durable move is the opposite instinct: disclose it deliberately, in a patent, and hold an enforceable right that does not evaporate the moment your knowledge escapes. It's one of the sharper cases for the patent bargain I've read this year.
