@MCKettemann @daphnehk @boomartins The court said. There is no rtbf enshrined in the brazilian constitution or law. To restrict FoE you would need a law (passed by Congress) according to the American Convention on HR. Therefore, there is no rtbf.

@MCKettemann @daphnehk @boomartins Ps2: a big part of the vote is exactly trying to narrow the scope of the rtbf (what is it?), then searching for it in the law and constitution (did not find), and then stating that it could not be derived by a general principle (e.g. human dignity) because it would violate ACHR.

Ps: as the rtbf is neither in the constitution nor in the law, there would not be case by case analysis on these grounds+
