أقر البرلمان العراقي في تاريخ ٢٧/٤/٢٠٢٤ تعديلاً على قانون "مكافحة البغاء والشذوذ الجنسي"، فبات القانون يعاقب المثلية الجنسية بالسجن لمدة تتراوح بين ١٠ و ١٥ سنة، ويعاقب بالسجن لمدة لا تقل عن ٧ سنوات كل من يروج لها أو يساعد على ذلك بأي وسيلة، بالإضافة إلى معاقبة كل من ارتكب فعل "التخنث" أو روج لذلك بالسجن لمدة تتراوح بين سنة و ٣ سنوات. ويعاقب القانون أيضًا بالسجن كل من أجرى عملية عبور جندري والطبيب الذي قام بالعملية. هذا القانون سيجعل حياة أفراد مجتمع الميم أكثر صعوبة ويزيد من التضييق عليهم، وقد يمنع أي عمل حقوقي حول قضاياهم.
On April 27, 2024, the Iraqi Parliament approved an amendment to the “Anti-Prostitution and Homosexuality” law. The law now punishes homosexuality with imprisonment for a period ranging between 10 and 15 years, and anyone who promotes it or helps to do so shall be punished with imprisonment for no less than 7 years. in addition to punishing anyone who committed the act of “effeminacy” or promoted it by any means with imprisonment for a period ranging from one to three years. The law also punishes anyone who performs a gender transition operation and the doctor who performs the operation with imprisonment. This law will make the lives of LGBTQ individuals more difficult, increase restrictions on them, and will prevent any queer-related human rights work.

On the occasion of the IDAHOBIT, Daraj, in collaboration with Helem, publishes figures on the violations that were documented in 2023 in light of unprecedented campaigns targeting LGBTQ individuals in Lebanon.
بمناسبة اليوم العالمي لمناهضة رهاب المثلية ورهاب إزدواجية الميل الجنسي ورهاب العبور الجندري ورهاب ثنائية الجنس ينشر موقع "درج" بالتعاون مع منظمة "حلم" أرقامًا عن الانتهاكات التي تم توثيقها عام ٢٠٢٣ في ظل حملات غير مسبوقة تطال أفراد الميم عين في لبنان.

وردنا يوم الاثنين 13 ايار 2024 نبأ صادم بالعثور على جثة امرأة عابرة مقتولة في منطقة الدورة – برج حمود، قُتلت جراء ضربها بآلة حادة على رأسها وتركت على جانب الطريق. اكتشفنا أن الشخص المقتول كان امرأة عابرة تدعى تالا وكانت معروفة ومحبوبة في مجتمعها. وبالإضافة إلى الجريمة البشعة، قام الأفراد الذين عثروا على تالا، بخلع ملابسها، والعبث بها، وتصويرها عارية، في خطوة مثيرة للاشمئزاز وتفتقر إلى أبسط القيم الإنسانية تجاه كرامة الضحية. ونشرت بعض وسائل الإعلام الصور التي التقطتها، وتعمدت التشهير بها، والكشف عن هويتها في انتهاك صارخ لخصوصيتها وسيادتها على جسدها.
باشر فرع المعلومات التحقيق في الجريمة، وأوقف شخصين متهمين بالتورط في الجريمة. ومن خلال مسار التحقيق وشهادات عدد من أصدقائها، يتبين بوضوح أن هذه جريمة كراهية موجهة ضد امرأة عابرة، مما يعكس كراهية واستهدافًا واضحًا لمجتمع الميم عين بشكل عام، وضد النساء العابرات بشكل خاص.
تود المنظمة التأكيد، بعد الاطلاع على شهادات ومعطيات من النساء العابرات في منطقة الدورة-برج حمود، أن هذه الجريمة ليست فردية أو معزولة، بل هي جزء من سلسلة اعتداءات وجرائم تستهدف النساء العابرات من قبل عصابات منظمة تفرض عليهن الخوات. في حال رفضن دفع الخوات، يتعرضن لشتى أنواع العنف الجسدي والنفسي، مما يزيد من معاناتهن ويضع حياتهن في خطر مستمر. هذا العنف المستمر يهدف إلى إجبارهن على الامتثال لمطالب العصابات المنظمة التي تستغل ضعفهن وحاجتهن للحماية، في بلد لا تقدم فيه الدولة أي شكل من أشكال الحماية للأفراد المهمشين/ات، بل بدلاً من ذلك تضطهدهن وتحرمهن من أي مأوى أو مساعدة ذات معنى، فلا يزال عدد لا يحصى من النساء العابرات عرضة لمستويات شديدة من العنف والابتزاز والاتجار بالبشر في لبنان، وكانت ضحيته الأخيرة "تالا".
بالإضافة إلى ذلك، تود منظمة حلم التأكيد على أن هذه الجريمة ليست منفصلة عن المحاولات المستمرة من قبل الجهات السياسية والدينية لجعل مجتمع الميم عين كبش فداء من خلال التحريض على العنف ضدنا. كما يساهم الانتشار المتواصل للمعلومات المضلل�� والأخبار المزيفة حول الكويريين/ات في زيادة الكراهية والعنف ضدهم/ن ويزيد من احتمالية وقوع جرائم مماثلة مع الإفلات من العقاب.
كما تدين المنظمة غياب المهنية لدى بعض وسائل الإعلام والصحفيين/ات في تغطيتهم/ن لهذه المأساة. إن نشر صور الضحية دون إخفاء هويتها يعد انتهاكًا صارخًا لخصوصيتها ويؤدي إلى تفاقم الألم الذي يعيشه أصدقاؤها وأحباؤها. وندعو وسائل الإعلام إلى تحمل مسؤولياتها الأخلاقية والقانونية في حماية هوية الضحايا واحترام كرامتهم/ن.
ستواصل "حلم" متابعة هذه القضية لضمان محاسبة قتلة تالا. نرسل تعازينا لأحبائها خلال هذا الوقت العصيب ونعمل على ضمان حصولها على دفن كريم.
وندعو الجهات الرسمية إلى تكثيف جهودها في مكافحة جرائم الكراهية وضمان حماية الأفراد من مجتمع الميم عين. كما ندعو المجتمع ككل إلى الوقوف ضد كافة أشكال العنف والتمييز والعمل على بناء مجتمع تسوده العدالة والمساواة.
Statement:
On Monday, May 13, 2024, we received the devastating news that the body of a trans woman was found dead in the Dawra-Burj Hammoud area, who had been killed due to a blow to the head with a sharp object and left on the road. We discovered that the person killed was a trans woman named Tala who was known and loved in her community. In addition to the hideous crime, the individuals who found Tala proceeded to remove the clothing of her body, tampered with it, and photographed it naked in a disgusting lack of basic humanity and civility to the dignity of the victim. Some media outlets published the photos they took , purposefully misgendered her, and revealed her identity in a flagrant violation of her privacy and her body sovereignty.
The Information Branch began investigating the crime, and two people accused of involvement in the crime were arrested. Through the course of the investigation and the testimonies of a number of her friends, it can be clearly concluded that this is a hate crime directed against a trans woman, reflecting clear hatred and targeting against the LGBTQ community in general, and against trans women specifically.
Helem would like to confirm, after reviewing testimonies and data from multiple trans women in the Doura-Bourj Hammoud area, that this crime is not individual or isolated, but rather part of a series of attacks and crimes targeting trans women by organized gangs that impose "protection fees" on them. If they refuse to pay, they are exposed to various types of physical and psychological violence, which increases their suffering and puts their lives in constant danger.
This ongoing violence aims to force them to comply with the demands of organized mobs that exploit their vulnerability and need for protection. In a country where the state does not offer any form of protection for marginalized individuals, but instead persecutes them and denies them any meaningful shelter or aid, countless trans women remain vulnerable to extreme levels of violence, extortion, and trafficking in Lebanon of which Tala is the latest victim.
In addition, Helem would like to emphasize that this crime is not separate from the ongoing attempts by political and religious actors to scapegoat the LGBTIQ community by inciting violence against us. The relentless spread of misinformation and fake news about queer contributes to increasing hatred and violence against them and increases the probability of similar crimes occurring with impunity.
The organization also condemns the lack of professionalism among some media outlets and journalists in their coverage of this tragedy.
Publishing photos of the victim without concealing her identity is a blatant violation of her privacy and exacerbates the pain her friends and loved ones are experiencing. We call on the media to assume their moral and legal responsibilities in protecting the identity of the victims and respecting their dignity.
Helem will continue following up on this case to ensure that the investigation holds Tala’s killers accountable.We send our condolences to her loved ones during this difficult time and are working to ensure that she receives a dignified burial.
We call on official authorities to intensify their efforts in combating hate crimes and ensuring the protection of individuals from the LGBTQ community. We also call on society as a whole to stand against all forms of violence and discrimination and to work towards building a more just and equal society.
