Ms. Truong My Lan was prosecuted for appropriating more than 304,000 billion VND from SCB
Ms. Truong My Lan, Chairman of Van Thinh Phat Group, was prosecuted for allegedly appropriating more than 304,000 billion VND from SCB Bank and bribing 5.2 million USD.

On December 15, Ms. Truong My Lan was prosecuted by the Supreme People's Procuracy on three counts of Bribery, Violation of lending regulations in the operations of credit institutions, and Asset embezzlement. The indictment was issued more than a month after the Ministry of Public Security concluded its investigation. The case will be tried at the Ho Chi Minh City People's Court.

Among the remaining 85 defendants prosecuted by the Procuracy, there are 45 leaders and officers of SCB Bank; 15 former State Bank officials; 3 former Government Inspectorate officers; a former State Audit officer. They were prosecuted for one of the following crimes: Embezzlement of property, Receiving bribes, Abusing position and power while performing official duties, Irresponsibility causing serious consequences and Violating regulations on bank operations row.

In this case, 5 people were prosecuted but escaped: Dinh Van Thanh and Nguyen Thi Thu Suong, both former Chairmen of the Board of Directors of SCB; Chiem Minh Dung, former Deputy General Director of SCB; Tram Thich Ton, member of the Board of Directors of SCB; Nguyen Lam Anh Vu, former deputy director of SCB Ben Thanh branch. Therefore, the Supreme People's Procuracy calls on these defendants to go to the nearest police or Procuracy to surrender, enjoy leniency and exercise the right to self-defense according to regulations. According to the indictment, with the policy of taking advantage of bank operations to mobilize capital for personal business, Ms. Lan acquired 3 private banks to merge into Saigon Commercial Joint Stock Bank (SCB), operating since 2011. SCB was used by Ms. Lan as a financial company to finance Van Thinh Phat's ecosystem.

Although she does not directly hold executive power, Ms. Lan owns 91.5% of SCB's shares through other individuals. After the successful acquisition, Ms. Lan directed the bank's leaders to coordinate with key officials at Van Thinh Phat to withdraw the bank's money in the form of disbursement for false loan applications. Many times, Ms. Lan instructed to withdraw money first and complete the documents later. Each withdrawal has a different method, "drawing" different options.

For 10 consecutive years, from 2012 to 2022, SCB disbursed money to 1,366 customers (710 individuals and 656 organizations). In particular, Ms. Lan's group has more than 2,500 loans at SCB with a total disbursement of more than 1,066,000 billion VND. The amount of money SCB lent to Ms. Lan's group accounted for 93% of the loan amount, the remaining 7% was for regular customers.

By 2022, 875 customers in Ms. Lan's group with nearly 1,300 loans have outstanding debt at SCB of more than 677,000 billion VND (483,000 billion VND outstanding principal, 193,000 billion VND interest). These debts are all in the unrecoverable group.

In order to legally withdraw money and avoid being traced by the police to detect violations, Ms. Lan instructed SCB officials to transfer disbursed money to ghost companies, then withdraw cash to cut off the cash flow.

According to the Procuracy, from February 2018 to October 2022, Ms. Lan directed the preparation of 916 SCB loan applications of 545,000 billion VND and appropriated 304,000 billion VND. In addition, Ms. Lan was also accused of causing interest losses of nearly 130,000 billion VND. In addition, Ms. Lan's actions also caused damage to SCB of more than 64,600 billion VND.
