Biology should not be the only factor in determining the rights of others to use language, the noun of sex to form a gender identity within the society.

Biology studies the organic process by which individuals are produced and species continuity maintained. Sociology studies the natural process where personality is formed and cultural continuity is maintained.

Your desire to compartmentalize someone’s sex at the moment of birth before full physical development is archaic. Fear mongering and exclusion does nothing protect your individual rights.
