The Court of Appeal has found that Agha Khan Hospital & one Consultant Doctor were negligent in the diagnosis of a minor who later passed on. The perhaps important principles that this case reiterates are:
1. It is not enough for a Hospital to dangle the defence of an independent doctor having been involved & that the hospital has no control over such a professional. ✅️
2. If a Consultant operates within the institutional framework of a medical facility, uses its clinical notes, was facilitated to come on board vide the hospital channels even if proposed by the patients themselves or the family, the duty of care by the hospital is still ALIVE. ✅️
3.The medical negligence test remains the Bolams test & not that of the person on the street. The bolams test is that of a professional averagely undertaking their art. The standard is not that of highest skill but that of a reasonable medical Practitioner doing due diligence, deploying their skills & expertise. Mere disagreement in medical opinions alone is not enough to establish medical negligence but omissions of a fundamental step that a reasonable professional would undertake is not protected.✅️

It is true that it is very difficult to prove sexual harassment. It is also true that many women weaponize sexual harassment to achieve certain outcomes.
Trying to make Maraga look like he is/was protecting the alleged perpetrator while he was not is definitely weaponizing sexual harassment.
