Café cargado. Pluma abierta. Y una pregunta que atraviesa los siglos con la misma facilidad con la que un estoque atraviesa una capa de humo surge en mi mente mirando hacia el monte Abantos.
¿Qué pensaría Felipe II si contemplara hoy algunos episodios de la Justicia española?
No hablo de jueces concretos.
Hablo de una atmósfera irrespirable para la sociedad civil.
De un tiempo en el que demasiados procesos parecen redactarse antes en determinados despachos políticos y mediáticos que en los propios tribunales de instancia.
Felipe II dejó escrito para quienes gobernaban en su nombre algo que debería estar cincelado sobre la entrada de cualquier palacio de justicia:
«Administrad la justicia con ecuanimidad y rectitud y, si es necesario, con rigor y ejemplaridad.»
No era una frase decorativa. ¿Buena, eh?
Era una forma de entender el poder en su máxima expresión geométrica.
Porque el monarca al que llamaron El Prudente desconfiaba incluso de sí mismo. Revisaba expedientes, exigía informes cruzados y convertía el procedimiento en un dique contra el capricho.
Sabía algo esencial.
Cuando la Justicia deja de ser una balanza para convertirse en una lanza, el Estado empieza a resquebrajarse y ya no representa la grandeza de una nación.
Y ahí es donde aparece una palabra que hace unos años parecía reservada para otros países y hoy forma parte del vocabulario político internacional.
Lawfare.
No consiste necesariamente en fabricar delitos.
Basta con convertir el procedimiento en el castigo.
Prolongar investigaciones hasta que el calendario haga el trabajo que no consiguen las pruebas ni los investigadores.
Filtrar diligencias con precisión quirúrgica en bares de periferia.
Construir un relato antes de que exista una sentencia.
Sembrar sospechas sabiendo que, aunque llegue una absolución años después, la reputación ya habrá sido ejecutada en la plaza pública como un cadalso.
Porque hay condenas que no necesitan Código Penal, solo un Auto de Fe de la Inquisición de Génova.
Y tambien les basta un telediario con esos presentadores con la mirada inyectada en despotismo.
Y cuando determinados actores políticos viven permanentemente alimentando ese mecanismo, uno empieza a comprender que no todos buscan justicia.
Algunos buscan munición de guerra.
Otros titulares.
Otros simplemente barro donde revolcarse.
El barro es un recurso político extraordinario.
No hace falta demostrar nada.
Solo salpicar, y cuanto más...mejor.
Después ya habrá tertulias, columnas, cuentas sincronizadas, ex de jueces y portadas que repetirán el mismo eco hasta convertir una hipótesis en una emoción colectiva.
El viejo principio jurídico de la presunción de inocencia queda entonces sustituido por otro mucho más rentable:
«Que explique por qué todavía no ha sido condenado.»
Es una inversión brillante.
Y profundamente peligrosa.
Porque la Justicia deja de investigar hechos para empezar a satisfacer expectativas creadas desde fuera.
Felipe II jamás habría tolerado semejante inversión del orden.
No porque fuera un ingenuo.
Todo lo contrario dentro de esa coraza de rectitud que paseaba por los largos pasillos que este escriba recorre de una vez en cuando.
Sabía que el poder siempre intenta utilizar la ley como espada.
Precisamente por eso insistía tanto en la ecuanimidad.
La rectitud.
El rigor.
La ejemplaridad.
Cuatro palabras.
Cuatro columnas.
Hoy, demasiadas veces, parecen haber sido sustituidas por otras cuatro:
Filtración. Titular. Sospecha. Desgaste.
Y entre quienes más combustible arrojan a ese incendio político se encuentra un Partido Popular que, lejos de ejercer una oposición basada en proyectos, en programas políticos, ha convertido con frecuencia la sospecha permanente en estrategia. La confrontación judicial, la amplificación mediática de diligencias aún abiertas y la explotación política de cualquier procedimiento terminan componiendo un ecosistema donde el adversario deja de ser un rival democrático para convertirse en un objetivo al que erosionar por cualquier vía.
Cuando el debate político abandona las ideas para instalarse en el lodazal, hay quien termina sintiéndose cómodo entre el barro.
La coprofagia política consiste precisamente en eso: alimentarse de los residuos del enfrentamiento permanente hasta confundir el fango con el alimento.
Y el problema del barro es que nunca distingue a quién acaba manchando y de eso Tellado es experto.
Hoy puede salpicar al adversario.
Mañana alcanzará al propio sistema.
Porque ninguna democracia sale fortalecida cuando la confianza en sus jueces empieza a medirse por afinidades ideológicas en lugar de por la solidez de sus resoluciones.
La Justicia no existe para satisfacer a gobiernos.
Ni para satisfacer a oposiciones.
Ni para fabricar héroes.
Ni para destruir enemigos.
Existe para proteger al ciudadano incluso cuando ese ciudadano resulta incómodo para el poder.
Ese era el sentido profundo de la advertencia de Felipe II.
No administrar emociones.
Administrar justicia.
Hay frases que envejecen como el oro.
Y otras que envejecen a quienes las ignoran.
Esta pertenece a la segunda categoría.
Porque un reino puede soportar malas cosechas.
Puede superar guerras.
Puede reconstruirse tras una crisis e incluso ganar el segundo mundial de fútbol.
Lo que difícilmente sobrevive es una sociedad que deja de creer que la balanza pesa igual para todos.
Y cuando la balanza deja de pesar…
solo queda el ruido.
Y el ruido jamás ha dictado una sentencia justa.
Siempre ha sacado a la gente a la calle a tomarse la justicia por su propia mano.

Rome conquered Greece in 146 BC when they burned Corinth to the ground. And then the strangest thing in ancient history happened. The winners spent the next few centuries desperately trying to become the losers.
It actually started before the final conquest. When the general Marcellus sacked Syracuse in 211 BC, he shipped boatloads of Greek statues and paintings back to Rome, and the city went crazy for it. Suddenly every rich Roman had to have Greek art in his house. Decades later Cicero built an entire court case around prosecuting a governor named Verres for looting Greek masterpieces, and Romans ate it up.
Then came the schools. Wealthy families started buying Greek slaves specifically because they were educated, and handed them the job of raising their children. So the sons of the men who crushed Greece grew up speaking Greek, memorizing Greek poetry, and learning philosophy from Greeks. The elite eventually sent their teenagers abroad to Athens and Rhodes to finish their education, the way people today send kids to study overseas. Cicero did it. Julius Caesar did it.
Their gods were Greek gods wearing name tags. Zeus became Jupiter. Hera became Juno. Aphrodite became Venus. Ares became Mars. Same myths, same family drama, mostly just relabeled.
Their entertainment was borrowed too. The first big Roman playwrights, Plautus and Terence, basically adapted Greek comedies into Latin. Their doctors were Greek. Their architecture leaned on Greek columns, the Doric and Ionic and Corinthian orders you still see on bank buildings today.
And the art obsession left a strange fingerprint on history. Romans loved Greek bronze statues so much that they mass produced marble copies of them. A huge chunk of what people walk past in museums today and call "Greek sculpture" is actually a Roman copy. The Greek originals melted down or vanished long ago. The knockoffs are what survived.
Not everyone was thrilled. Cato the Elder spent his whole life warning that Greek culture would rot the Roman character. He sneered at Greek philosophers, distrusted Greek doctors, and wanted them kept out of the city. And then, as an old man, he quietly sat down and learned Greek anyway. Even the loudest hater caved.
The trend went all the way to the top. Virgil wrote the Aeneid, Rome's national epic, by openly modeling it on Homer. The emperor Nero competed in Greek games and toured Greece like a superfan. Hadrian was so obsessed he grew a Greek philosopher's beard and poured money into rebuilding Athens. And Marcus Aurelius, master of the entire Roman world, wrote his private journal not in Latin but in Greek, because that was the language of serious thinking.
The poet Horace nailed it in a single line: captured Greece took her savage conqueror captive. Rome won every war on the battlefield and then handed its whole soul to the people it had beaten.
