Key Point - both the BC and Federal government chose NOT to defend private property rights - with major potential legal consequences for other land claims

"Paragraph 2086 of the Cowichan Tribes decision, you will see the court noting that the government of British Columbia chose NOT to argue that issuing private property grants extinguished Aboriginal title. They didn't argue it nor did the government of Canada... it's very important to understand that on this key issue, the court expressly noted the two governments didn't even argue it. (ie protect private property rights)"
