I am not convinced about that double nomination ruling though. Why introduce mens rea (intent) in a double nomination case? A combination of actus reus (the act) and mens rea (the intent) is only relevant in establishing whether a crime has been committed. The two must be present for a crime to be proven. Double nomination is not a crime, so the test should simply be “Was there double nomination or not?” Mens rea (intent) to be double-nominated or to benefit from double nomination is totally irrelevant. To my mind, the 25% issue was a non-starter. The forfeiture issue, although odious and offensive to morality, did not actually offend the Constitutional eligibility to run for office, if you look at it with the cold lens of legality. But you see that double nomination? It was simply a matter of dates. According to the dates, was there double nomination according to the Electoral Act or not? Intent is irrelevant. I look forward to hearing the Supreme Court’s views. And before you abuse me, respect my track record of often being right. 😊
This is the weakest submission in the history of electoral petitions in Nigeria. He didn't tell the court how he won, how he got the required spread constitutionally, or how the election was rigged. Nowhere did he provide evidence that he got majority votes or that he got 25% in 24 states.
He had issues with iRev, but he couldn't prove with hard copies of EC8 that what was uploaded on iRev was wrong compared to his EC8 and the error margins were significant enough to upturn the election.
The Constitution is clear on eligibility. He didn't show how the Tinubu's nomination violated the constitution. He couldn't also prove that the forfeiture was criminal.
Complete waste of time. His lawyers should be fined.
In the hall of fame of absurdities the prayers presented at tribunal should be framed for entertainment of future students of Law.
How does anyone claim to have won an election based solely on pejoratives, assumptions, vague rhetorics and zero evidence pointing to such being the case, but on the expectation that the actual winner would be disqualified and by some stroke of black magic the candidate in 3rd place will suddenly be declared winner, without any proof of having the majority vote. #PEPTJudgement 🤷🏾♂️

Thank you for your feedback. Well, you may be right. And I also believe that Ironsi meant well. But many of his critics felt that Ironsi’s decree number 34 was the handiwork of his three man advisory committee, and the fact that all members of that committee were Igbo (Chief Francis Nwokedi, Dr Pius Charles Nwabafor Okigbo and Colonel Patrick Anwunah) did not help matters.
The preamble to that decree read as follows:
“Subject to the provisions of this Decree, Nigeria shall on 24th May 1966 (in this decree referred to as ‘the appointed day’) cease to be a Federation and shall accordingly as from that day be a Republic, by the name of the Republic of Nigeria, consisting of the whole of the territory which immediately before that day was comprised in the Federation.”
Ironsi thereafter stripped the regions and their appurtenances of any power over their resources and assets and domiciled such powers hitherto held by them on the ‘National Military Government’ headed by him.
One of the biggest myths existing in Nigeria today is that the current system of government that we have, which is a false federation that is, in fact, a unitary system, is a creation of Northern Nigeria to dominate other parts of Nigeria.
It was Ironsi, as military dictator, who actually ended true federalism in Nigeria by promulgating Decree No. 34 of 1966, which was also known as the Unification of Assets decree.
Yes, Northern Nigeria is heavily benefiting from it. Northern Nigeria is sustaining it. However, Northern Nigeria did not create it. And when oil runs its course as a commercially viable commodity, it is even possible that Northern Nigeria itself may come to a position where it does not even find it as attractive as it once did.
This myth that our present faux federalism is a Northern construct has persisted because Nigerians hardly read about or study their history. As a people, we are, with a few exceptions, focused on the here and now without much thought to how we got to where we are.
Decree 34 killed regionalism and true federalism and was a most unwise move from Aguiyi Ironsi that Nigeria is still paying for today.
And it further exacerbates the situation when Southerners, especially people of Southeastern origin, accuse the Hausa of dominating them.
The truth is that only one Hausa man has ever governed Nigeria, and he governed for only nine months (Abdulsalami Abubakar). Murtala Mohammed and Muhammadu Buhari were/are partly Fulani. None of them had Hausa blood.
Only Murtala’s mother was Fulani, and only Buhari’s father was Fulani. Both of them grew up without their fathers.
The only pure Fulani to have governed Nigeria was Shehu Shagari, perhaps one of the most decent human beings this land has ever produced.
Umaru Musa Yar’adua was Tuareg.
Tafawa Balewa was from an ethnic nationality called Gere, one of the first Northern people to accept Western style Christianity and education.
Yakubu Gowon is alive and can testify that he is an Ngas by ethnic origin.
I left Ibrahim Babangida to the end because, as is typical with most things Babangida, his ethnicity is deliberately shrouded in controversy. And because of that, I will not add to that controversy beyond saying he is of uncertain ethnicity.
Sani Abacha is pure Kanuri, although he claimed to be from Kano.
The conclusion of the matter is that Hausa domination is a MYTH! And ever since the Shehu Uthman Dan Fodio Fulani Jihad of 1804–1808, the Hausas have been the most denigrated, downgraded and marginalised ethnicity in the geographical entity now known as Nigeria.
Even the one Hausa man who became Head of State for nine months, Abdulsalami Abubakar, got there purely by chance. He was to be retired by Abacha, but Abacha died before he could sign his retirement papers. Oladipo Diya, who would have automatically taken over as Abacha’s deputy, had been convicted of coup plotting. Leaving Abdulsalami as the next in line according to military hierarchy.

Are you aware that it was Major General Johnson Thomas Aguiyi-Ironsi who, as military Head of State, abrogated true federalism, where each region controlled their resources and only paid 25% tax to the central government? He did that with the Unification Decree Number 34 of on May 24, 1966.
Are you also aware that both the trio of the Northern, Western and Midwestern Regions rejected Decree Number 34, but it was gazetted and be and part of the Laws of the Federation of Nigeria? Only the Eastern Region accepted it. There were riots in other regions over Decree Number 34. Please research it.
And how can you say that other regions decided to eliminate one region? Are you aware of history at all?

In light of the above, perhaps you may want to revisit your claims? Others may find it insensitive and provocative.
Also, the idea for a secession clause was mooted by Chief Oba Femi Awolowo in 1954 during the Lagos Constitutional Conference, but Nnamdi Azikiwe rejected it and galvanised a majority of the conference attendees to kill the idea.
After this was rejected, Chief Awolowo again wrote to the then Governor General of Nigeria, who rejected the clause on the grounds that the majority, led by Nnamdi Azikiwe, were not in support of it.
It was because of Nnamdi Azikiwe that section 86 was inserted into our constitution with the proviso that if any region should secede, it would be an act of treason.
Nnamdi Azikiwe himself wrote about this in an essay, which was published by the New Nigerian Newspapers in 1975 and has since been republished by other papers and by Mr. Azikiwe himself.
Were it not for Azikiwe, Biafra would have had the legal right to secede.
David, it would be best if you purged yourself of these baseless allegations fed to you. This was one of the main failings of the Nigerian government. If you live in Europe, you will find that the history of the Second World War is always told every day on various TV stations, so people will be aware of what happened and will not repeat history.
It also ensures that the younger generation is not indoctrinated with lies that may radicalise them against their neighbours.
