Lula will face a Congress with the largest opposition controlled he has ever faced.
Having now forced the opponent in the Brazilian presidential election, if Lula pursues the same path as Maduro after the opposition won control of the Venezuelan legislature with 2/3 majority in December 2015 what steps might we see in Brazil in the coming weeks and months?
Before the new legislators took office, the outgoing government controlled legislature rushed through the appointment of 13 Supreme Court justices and 21 alternates. Lula already controls 9 of 11 in the STF.
The Venezuelan Supreme Court then suspended elected representatives from Amazonas, depriving the opposition of its two-thirds majority. When the legislature seated the three opposition deputies, the judges declared it in “contempt.” That dispute became the justification for treating the legislature’s decisions as null and void.
Throughout 2016, the Venezuelan STF equivalent blocked legislation, including an amnesty for political prisoners. It upheld Maduro’s emergency decrees despite parliamentary opposition and authorized him to submit the national budget to the court instead of Congress. Judges progressively transferred the elected legislature’s authority to themselves and the executive. Sounds familiar?
The government also closed the other constitutional routes to change. Regional criminal courts issued injunctions against the presidential recall process; the electoral authority used them to suspend it in October 2016. Regional elections were postponed. Political imprisonment and repression raised the cost of resistance.
In March 2017, the Supreme Court went further, announcing it would exercise parliamentary powers itself.
Later that year, Maduro installed a parallel Constituent Assembly through an election boycotted by the opposition. It claimed supremacy over state institutions and assumed legislative powers, sidelining the parliament Venezuelans had actually elected.
The legislature could still meet. Its members could still speak. But the regime had stripped away their ability to legislate, control spending and hold the executive accountable.
That is how Maduro neutralized an electoral defeat by capturing judges, emergency rule, increased political persecution of the opposition, repression and, finally, a parallel legislature.
What could an independent audit actually uncover about the Zanin Window?
Consider a hypothetical candidate named Lolo with privileged technical access. Lolo might attempt to substitute section results, alter aggregation records or interfere with which results were accepted. Those attempts would have to overcome safeguards and survive comparison with authentic local tallies. The Zanin Window itself would not grant that access. Nor would it erase the printed Boletins de Urna already held outside central custody.
That gives investigators a concrete test. You could compare independently preserved originals with signed electronic files, every accepted or replaced version, and the published totals. Examine administrative access and changes before, during and after the interruption.
A separate hypothesis—compromised machine software before local tallies were generated—requires different testing and would not depend on the Zanin Window.
An independent audit with international experts and observers should establish whether any records changed without justification, whether safeguards held, and whether any discrepancy could affect the outcome.
The audit must be capable of exposing manipulation—and of clearing the system if the records support it.
CRUCIAL FACTS ON THE FLAVIO BOLSONARO MATTER:
It's not just Flavio Bolsonaro who fled Brazil to escape the tyrannical persecution of Alexandre de Moraes and the pro-Lula wing of the Supreme Court. There are dozens of Brazilian exiles who have done the same: dissident journalists, activists, bloggers, and politicians who all fled to avoid certain prison for political opposition.
In most of these cases, Moraes has demanded the extradition of those who fled and whom he wants to imprison back in Brazil. But Moraes' extradition requests have been repeatedly denied by multiple countries and institutions on the grounds that these prosecutions are politically motivated or otherwise corrupted. Among those concluing this: Spain, Italy, INTERPOL, and even the US under Biden.
Just today, Italy refused Brazil's demand to extradite a person named @edutagli, who was once a top aide to Moraes, but then fled to Italy after Moraes accused him of having been my source in a huge leak from Moraes' office that I obtained for reporting I did with @Folha in 2024. That massive leak enabled us to publish roughly 20 articles proving systemic abuses of power by Moraes against his political enemies: exactly the reason so many Brazilians, including Bolsonaro, know they can't get a fair trial in Brazil.
Italy today refused to extradite the person accused of being our source on the grounds that the proceedings would be a farce because Moraes — as he so often does — wants to act as the supposed victim, investigator, and judge, and thus his demand falls well outside of Italy's extradition standards. Again, multiple countries have concluded the same, showing what a farce Brazil's once-respected judicial system has become under the Lula/Moraes regime.
Moraes has overseen a system of political persecution masquerading as criminal justice that has been recognized as a sham by multiple countries that are not exactly Bolsonaro allies. Nobody in their right mind who is a political enemy of Moraes would remain in Brazil once if it is clear that he intends to imprison you, since he has proven that guilt is a foregone conclusion and he operates with no legal or constitutional limits of any kind.
That is why asylum under international law exists: to protect those who cannot obtain justice in their own country because the justice system has been corrupted and commandeered for political persecution. Many people, such as Julian Assange, have needed that protection (which Lula cheered). Now people need it from Moraes in Brazil. That is sadly one of the main legacies of both Lula and Moraes over the last six years.
