Na teoria, a regra vale para todos, mas o histórico recente brasileiro acende o alerta - as medidas mais severas de bloqueio e restrição nas redes atingiram reiteradamente vozes ligadas à direita. E agora Elon Musk colocou luz sobre o mecanismo.

Ao anunciar a abertura do código da nova versão do “For You”, o X expôs seu sistema de recomendação. Musk foi explícito ao republicar o anúncio: “Qualquer censura exigida por governos agora está claramente visível.”

No Brasil, o art. 28, §1º-A, da Resolução 23.610 do TSE determina que plataformas com sistemas de recomendação devem “excluir dos resultados” os canais e perfis oficiais informados à Justiça Eleitoral pelas campanhas e, salvo hipóteses legais de impulsionamento pago, também os conteúdos publicados por eles.

Na prática, não é preciso apagar ou bloquear uma publicação para limitar seu alcance. O conteúdo existe; o que desaparece é a possibilidade de chegar organicamente a quem ainda não o conhece.

Não se trata apenas de retirar conteúdo considerado ilegal após a análise de um caso concreto, mas de interferir previamente na distribuição do discurso político durante uma eleição.

O Brasil já viveu bloqueios de contas, remoções de conteúdo e até a suspensão nacional do próprio X. Agora surge uma modalidade muito menos perceptível, o conteúdo permanece publicado, mas seu alcance pode ser restringido por determinação estatal.

E Musk acaba de retirar justamente o elemento indispensável para esse mecanismo operar longe dos olhos do público; a falta de transparencia.

A Justiça Eleitoral brasileira agora chega diretamente nos sistemas que decidem o que será recomendado ao eleitor. Não estamos falando apenas de moderação de conteúdo, estamos falando de poder sobre aquilo que o eleitor terá - ou não terá - a oportunidade de ver antes de escolher seu voto.
