Defamation is made a criminal offence in Nigeria to shield the real thieves, chiefs, politicians, pastors and imams, traditional rulers and govt officials from criticism.
How does it make sense that a defamed person will have a choice to pursue a case in civil court or criminal court? Criminal process means that his personal matter is taken as public problem when it’s no in public interest. Public funds and scarce resources will be used to prosecute the personal matter while public schools, hospitals and roads are not being properly funded.
Defamation in all civilised and law abiding and responsible countries is a civil matter with redress in tort and not in crime.
Criminal defamation is being used as a tool and weapon against the weak, vulnerable and those in opposition.
