Women’s rights are being quietly rewritten in law.
In the latest Federal Court decision in the ongoing Giggle case, the court upheld that “gender identity” protections under anti-discrimination law can override single-sex spaces. Even those created exclusively for women.
The law is drifting away from biological sex as a protected category, and in doing so, is stripping away the legal certainty women once had around female-only spaces and services.
If sex no longer has clear legal meaning, then women’s boundaries in law are no longer fixed. They’re negotiable.
And once rights become negotiable, they stop being rights at all.
