There is this company, Fantasia Distribution also known as Fantasia Tobacco that has their attorneys sending letters to every small business smoke shop, vape shop, and head shop across the country. They say that everyone is infringing on their trademark "Ice". They don't seem to be able to provide anyone with proof of an FDA pre-market "granted" status for any of their products. This puts into question the legal statuses of the products they claim to have right now on the market for their trademark use claims. They do not have any PMTA from the FDA on any of their products.

It seems they are deliberately targeting the small businesses to not only try and scare retailers into making large one-time payments that are in the thousands of dollars, which some stores are reporting but also phishing for distributor information as well. I have never seen anything like it. It is a very strange business plan they have. The Pacific Legal Group, which represents Fantasia, said this in an email to me this evening in regards to info: "Our client did not skip distributors and wholesalers, they have now proceeded to retailers to help get to all the wholesalers and distributors and even back up to the manufacturers" They claim they have always been enforcing their trademark. It honestly seems like they were waiting until the market was fully saturated with said trademark. The timing is very suspect. In 10 years, I have never heard of a popular market brand having to change their product title and packaging over the word "ice". It's a pretty common term that companies have used with vape e-liquids for over a decade now.

There have been talks of a class action against Fantasia by all these small businesses that are being hounded for payments and threatened during these truly difficult economic times, especially in retail. I really hope that happens. But more importantly, you know now who not to do business with. Please spread the word 🙏
