COURT HOLDS POLICE LIABLE AFTER CAR ENGINE GOES MISSING IN SAPS STORAGE
The High Court has found the Minister of Police liable for damages after a woman’s Volkswagen Golf was returned from police storage with its engine and several components missing.
The vehicle had been recovered west of Pretoria and taken to the SAPS 13 storage facility in Pretoria West.
Although police records indicated that the engine was present when the vehicle was released, the officer who completed the paperwork had not physically inspected it.
The court found that the vehicle had entered storage with its engine intact and rejected suggestions that the components could have been removed while it was being towed to a mechanic.
The court also ruled that an indemnity signed by the owner did not automatically protect the police from liability.
Enforcing it under these circumstances would be unfair and contrary to public policy, given the police’s duty to safeguard property in their custody.
The ruling sends a clear message: police cannot escape responsibility when property entrusted to their care is lost or damaged through negligence.
