The 1951 Refugee Convention is 75 years old. Seventy-five.
I understand why refugee protection was established after WWII,
but how do we apply a framework born in 1951 to the realities of 2026 without seriously reviewing whether it still fits today’s population, migration pressures, infrastructure and available resources?
The world has changed dramatically. Why hasn’t the framework evolved with it?

We are often told in court judgments, that the courts cannot reward criminality. For example, a court cannot allow you to keep stolen stuff, despite the fact that you didn't know it was stolen, when you bought it. But when t comes to refugees, suddenly criminality is rewarded.
The Constitutional Court cannot selectively interpret the Constitution while overlooking its express limitations. Sections 26(2) and 27(2) explicitly require the progressive realisation of socioeconomic rights within the state’s available resources, while Section 36 provides for the reasonable and justifiable limitation of rights. Fiscal constraints are not an afterthought they are expressly recognised in the Constitution itself! The judiciary must give equal weight to these qualifications instead of interpreting constitutional obligations as though public resources were unlimited.
Government really thinks we have short memories. Remember the panic before 30 June? Suddenly there were plans, measures, deadlines and promises everywhere. We were told to calm down.
30 June came and went. Most of that disappeared with it.
The lesson is simple.... this government only moves when its feet are held to the fire. Give them breathing room and they go straight back to doing nothing. Then the crisis returns, they make promises, we calm down, and the cycle starts again. 🤡
