THE BMA SUCCESSFULLY PROCESSES ANOTHER GROUP OF 663 GHANAIAN NATIONALS ON REPATRIATION THROUGH OR TAMBO INTERNATIONAL AIRPORT
The Commissioner of the Border Management Authority (BMA), Dr Michael Masiapato, has confirmed that the BMA successfully processed 663 Ghanaian nationals for repatriation from South Africa to Ghana through OR Tambo International Airport over the weekend. The repatriation process was coordinated through the Port Management Committee (PMC), comprising various government stakeholders responsible for facilitating lawful and orderly movement across the port of entry.
On Saturday, 6 June 2026, a group of 332 Ghanaian nationals was brought to OR Tambo International Airport by the Ghanaian High Commission in Pretoria for repatriation. Following an extensive check-in process, the travellers proceeded to BMA Immigration for verification and clearance.
Of the travellers processed, 170 were travelling on Ghanaian ordinary passports, while 162 were using Emergency Travel Certificates issued by the Ghanaian High Commission in Pretoria. Emergency Travel Certificates are single-use travel documents issued to facilitate the return of citizens to their country of origin.
During immigration processing, 321 travellers were found to have overstayed their allocated period of stay in South Africa by 30 days or longer. Consequently, they were declared undesirable in terms of Section 30 of the Immigration Act, read together with Regulation 27(3)(c) of the Immigration Regulations.
At the conclusion of the immigration process, 323 passengers were found eligible to depart and subsequently boarded a chartered flight arranged by the Government of Ghana through its High Commission in Pretoria.
Nine passengers were, however, offloaded from the flight. These included two couples and their five children. The wife of one couple and the husband of the other were declared medically unfit to travel by airline personnel. Airport paramedics were called to assist and subsequently transferred the two travellers to the airport clinic for further medical attention.

Constitutional Review Committee Legal Advisor Warns that Informal Trading Can Not Be Reserved for South Africans Only Like Other Countries Because it "may result in a limitation of the right to human dignity"
Co-founder of South Africans for Constitutional Reform (SACR) Princy Mthombeni shared that the Constitutional Review Committee received firm legal advice against restricting informal trade to citizens only. The advisor warned this could undermine constitutional protections and South Africaโs international commitments, referencing a key Supreme Court of Appeal judgment on refugee rights.
The Somali Association of South Africa case against the Limpopo Department of Economic Development, Environment and Tourism established that Section 22 does not bar asylum seekers and refugees from self-employment in spaza and tuck shops. The court ruled they are entitled to apply for informal trading licences when facing barriers to wage work.
โIf some refugee or asylum seeker be unable to obtain wage-earning employment and is on the brink of starvation, which brings with it humiliation and degradation, that person can only sustain him or herself by engaging in trade,โ the advisor quoted from the judgment, stressing reliance on Section 10 dignity rights.
โThe court consequently held that the concerned asylum seekers and refugees were in fact entitled to apply for the relevant informal trading licenses based on the right to dignity,โ the legal advisor added, noting that changes would require amendments to the Businesses Act of 1991.
โRestricting informal trade to citizens may result in a limitation of the right to human dignity as guaranteed by Section 10 of the Constitution,โ the advisor stated, highlighting risks under the African Charter, ICCPR, ICESCR, and the 1951 UN Refugees Convention.
Committee discussions also stressed that many public concerns, including a proposal to amend the Preamble to โSouth Africa belongs to its citizens,โ should be addressed through ordinary legislation rather than constitutional changes to avoid conflicts.
