Hoy un juez federal dijo algo muy distinto: concedió un amparo al considerar que la reforma de 2024 no sólo cambió la forma de elegir jueces, sino que pudo haber rebasado los límites del propio poder que la aprobó. No anuló toda la reforma, pero volvió a poner sobre la mesa una pregunta que parecía prohibida: ¿existen límites para reformar la Constitución?

La sentencia sostiene que la independencia judicial no es un privilegio de jueces y magistrados, sino una garantía de todos. También cuestiona la forma en que se aprobó la reforma y abre un debate de enorme calado: si una mayoría puede modificar la Constitución, ¿también puede impedir que alguien revise si esa modificación respetó las reglas y los derechos fundamentales?

Lo más delicado viene ahora. Quienes llegaron a la Suprema Corte gracias al nuevo modelo serán, muy probablemente, quienes decidan si ese mismo modelo fue constitucional.
