I was the guy who marked up Act 4 for the PR House. If demand declines or rate base shrinks, the solution is a higher transition charge. The true up mech here was designed to insure that the amounts due under the established transition charge were fully paid over everything else.

@AndrewScurria Furthermore, the "true up" mechanism isn't about declining electricity demand, but with failure to pay electric bills on time. When the PR govt is guilty of ~50% of PREPA's late payments, plus what you add with problems in economy, those who pay on time'll always be "true-upped"

Reading the scuffle today between AAFAF and the press over the PREPA "transition" rate raise. Both seem to keep 'forgetting' about the "true up" mechanism of Art. 6.25A of Act 4-2016, which will be the real screw up for ratepayers on their bill.

@AndrewScurria I haven't read the most recent RSA, but the section of Act 4 that I quoted has not been amended by any of the following acts (and there's been a chance to do it). As long as the language is there, it can be enforced.
