A Swedish court is under fire after an African migrant raped 16-year-old Meya Åberg, with the court ruling the migrant could not be deported because the rape did not last long enough.

The victim is now speaking out.

"During the whole school year, last year, I was hardly at school. Now and then I still dream about it. And I’ve been really scared to go out and walk by myself. I almost never go out by myself now."

The horrific rape occurred on Sept. 1, 2024, when Meya finished her shift at McDonald's but missed her bus home.

As she was walking under an underpass when Yazied Mohamed grabbed her phone, pinned her down, and raped her.

She was able to eventually break free and run from the scene. He was arrested and tried. Although the Court of Appeal sentenced him to 3 years in prison, it also ruled the rape did not constitute an “exceptionally serious offense" that could justify deportation.

Meya, however, said her life was "destroyed."

"I still break down when I sit and talk about it for a long time and get into details. It’s like I’m reliving again and I feel his hands on me," said the victim.

The court ruled that among other factors, the rape's "duration" was not long enough.

“Rape is, in many cases, considered an exceptionally serious offense that could lead to the deportation of a refugee, but an assessment must be made based on all circumstances in the individual case. Given the nature and duration of the offense in question, the Court of Appeal finds that while the crime is serious, it does not constitute an exceptionally serious offense that would warrant a deportation order for Yazied Mohamed. The request for deportation is therefore rejected,” the Court of Appeal for Upper Norrland wrote in its ruling.
