While everyone was focused on the ALJ stay this week, Treasury and the IRS quietly did something more interesting.
On September 29, the same day as the stay, they formally made Section 280E guidance an official federal priority for 2026-27. It wasn't on last year's list at all. Now it's one of 121 projects they've committed resources to for the fiscal year.
This isn't housekeeping.
Treasury has already said it expects a transition rule generally treating the April scheduling change as applying for the entire taxable year in which it took effect. For calendar-year filers that could mean qualifying medical activity gets relief back to January 1, not April 22.
They're also writing guidance for companies running both medical and adult-use operations, including how to apportion expenses between activities still subject to 280E and those that aren't. For the MSOs that make up $MSOS, that's one of the biggest practical questions hanging over the sector since April.
Worth being clear about the limits. Inclusion sets no deadline. It doesn't eliminate 280E for anyone. And all of it is written against the April order, which is under challenge in the D.C. Circuit.
Within 24 hours, one part of the government paused a proceeding over a report about written procedures. Another committed to building the tax plumbing that makes the reform already on the books actually function.
Only one of those got any attention.
