I wouldn’t call state willfully ignoring the law that calls for preserving evidence or notifying the destruction thereof a ‘technicality’. It’s obstruction. That law is in place for a reason. You differentiated forensic and witness evidence yourself in your tweet. Forensic evidence is the evidence (validity of which is refutable in this case), and witnesses give testimony.
