The difference between fan art and licensed use is one of the most useful intellectual property lessons, because this is where affection, creativity, and the creator’s rights meet and are often confused.
Fan art means a fan makes a new image, story, clip, or version based on an existing work, That can show real interest and real skill.
But making a derivative work does not usually mean the fan owns any part of the original.
The character, world, name, story, and core elements still belong to the rights holder.
Contribution to an work’s popularity is not the same as ownership.
Licensed use is different.
Here the rights holder, or someone authorized to speak for them, defines.
what is allowed:
republishing, teaching, adapting, selling, or only non-commercial use. Fan art may have cultural value, but without a license it does not create a legal right to use the original IP.
Students should also understand that an idea, a skill, or a feeling of fandom does not automatically create protectable IP.
Loving a character, drawing that character well, or taking inspiration from a story does not by itself create an exclusive right, What is usually protected is a specific expression of a work, not the mere idea or the fan’s attachment to it.
The classroom takeaway is simple: you can love a work, credit its creator, and even make something inspired by it, but that does not make you an owner of the original.
Attribution is not a substitute for licensing, and fan art by itself does not grant permission to exploit the IP.

If movie or game cards and collectibles are used in class, the first question is not how beautiful or popular the work is, The main question is whether there is actually a license to use it ?
Owning an NFT does not mean owning the copyright, trademark, or the right to use the original work for teaching or commercial purposes.
An NFT can at most show ownership of a specific digital asset; it does not confer ownership of the story, character, music, or world behind that work.
Provenance can clarify the history of a record, but it does not prove that no one else has rights.
For teachers and students, this distinction matters: seeing a scene, holding a collectible, crediting the creator, and obtaining a license to use the work are four separate things. Attribution is not a substitute for licensing. Being a fan or making fan art also does not make someone a co-owner of the original work.

Most people still think “IP onchain” means slapping a logo on a JPEG and calling it a day.
Soneium is doing something different for example They’re treating IP like it can actually live here not just get parked.
The part that stuck with me is the relationships around the IP. Who created it, who built on it, who showed up for it, how the community formed around it.
That history usually disappears but On Soneium it doesn’t have to.
That’s why the living IP idea feels more interesting than another drop. It’s not just ownership of the asset. It’s ownership of the story that keeps growing around it.
Sony already has the catalogs people actually care about. If they keep connecting those worlds to fans and creators without turning everything into merch, this becomes one of the few chains where entertainment doesn’t feel bolted on.
That’s the part I’m watching.
